1. Definitions
In these Terms and Conditions, the following words have the meanings set out below:
- "We", "Us", "Our" — Thayat Legal, a legal practice registered in Chiang Mai, Thailand.
- "You", "Client" — any individual or entity who visits our website or engages our services.
- "Services" — the legal consultations, estate administration assistance, and inheritance resolution support described on our website.
- "Website" — the website accessible at thayatlegag.pro.
- "Engagement" — the formal agreement by which you instruct us to act on your behalf.
- "Matter" — the specific legal matter for which you have engaged our services.
2. Acceptance of Terms
By accessing our website or engaging our services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our website or engage our services.
Our services are intended for individuals aged 18 and over who have the legal capacity to enter into a binding agreement. By proceeding, you confirm that you meet this requirement.
3. Our Services
Thayat Legal provides legal services in the following areas:
- Planning and Wishes Consultation — guidance on preparing a will and arranging an estate, delivered at a considerate and unhurried pace.
- Estate Administration Assistance — support with documentation, correspondence, and the procedural steps following a bereavement.
- Inheritance Resolution Support — assistance preparing, documenting, and presenting a client's position in inheritance matters.
Our services are offered to clients in Thailand and to expatriates residing in Thailand. All services are subject to Thai law. We do not provide services that would require us to practise under the laws of another jurisdiction.
The information on our website is provided for general guidance only and does not constitute legal advice. A formal engagement is required for advice specific to your circumstances.
4. Engagement of Services
An engagement begins when both parties have agreed in writing (including by email) on the scope of services, fee, and terms. Submitting an enquiry form does not in itself create an engagement or a solicitor-client relationship.
We reserve the right to decline any engagement at our discretion, including where a conflict of interest exists or where the matter falls outside our areas of practice.
The scope of each engagement will be set out in a written instruction letter or equivalent communication prior to work commencing. Any changes to scope will be agreed in writing.
5. Fees and Payment
Our fees for each service are as set out on our website at the time of engagement and confirmed in our instruction letter. All fees are quoted in Thai Baht (฿) and are inclusive of any applicable taxes unless stated otherwise.
- Payment terms will be specified in the instruction letter for each matter.
- We may request a deposit or staged payments for longer matters.
- Disbursements (such as court fees or document registration costs) are payable in addition to our fees and will be disclosed in advance.
Where you wish to withdraw from an engagement after work has commenced, fees may be due for work completed to that point. We will discuss any such amount with you openly and fairly.
6. Client Responsibilities
To allow us to act effectively on your behalf, you agree to:
- Provide accurate, complete, and timely information when requested.
- Notify us promptly of any changes to your circumstances that may be relevant to your matter.
- Respond to communications within a reasonable time.
- Not use our services for any unlawful purpose or in a manner contrary to Thai law or professional rules.
We cannot be responsible for delays or adverse outcomes arising from incomplete or inaccurate information provided by you.
7. Confidentiality
We treat all information shared with us in the course of an engagement as confidential. We will not disclose your information to third parties except where required to do so by law, with your consent, or where necessary to deliver the services you have engaged us for.
Our confidentiality obligations continue after the conclusion of the engagement. Please also see our Privacy Policy for details of how personal data is handled.
8. Intellectual Property
All content on this website — including text, design, structure, and branding — is the property of Thayat Legal and is protected by applicable intellectual property laws. You may not reproduce, distribute, or otherwise use any part of this website without our prior written consent.
Documents and written advice prepared specifically for your matter remain the work product of Thayat Legal. Upon full payment of fees, you receive a non-exclusive right to use those documents for the purpose for which they were prepared.
9. Disclaimers
The general information on our website is provided in good faith but does not constitute legal advice. We make no representation that the information will be accurate, complete, or up to date at all times.
Legal matters are inherently subject to uncertainty. While we will act with care and competence, we make no assurance as to any particular outcome. The result of any legal matter depends on many factors outside our control.
Our website may contain links to third-party sites. We are not responsible for the content or practices of those sites.
10. Limitation of Liability
To the fullest extent permitted by Thai law, our total liability to you in connection with any engagement shall not exceed the fees paid by you for the specific matter giving rise to the claim.
We shall not be liable for any indirect, consequential, or purely economic loss arising from the use of our website or services, or for circumstances beyond our reasonable control (including delays caused by courts, government authorities, or third parties).
Nothing in these Terms limits liability that cannot be excluded by law, including liability for fraud or gross negligence.
11. Termination
Either party may bring an engagement to a close by giving reasonable written notice to the other. We will always discuss any concerns with you before withdrawing from a matter where doing so may disadvantage you.
Upon conclusion of an engagement, we will provide you with any original documents in our possession that belong to you. We retain the right to keep copies of all correspondence and documents for our records.
12. Dispute Resolution
These Terms and any engagement are governed by the laws of Thailand. Any dispute arising in connection with our services shall first be referred to direct discussion between the parties in good faith.
If a dispute cannot be resolved informally within 30 days, the parties may seek resolution through the relevant professional body or, where necessary, through the courts of Chiang Mai Province, which shall have non-exclusive jurisdiction.
13. General Provisions
- Entire agreement: These Terms and any written engagement letter constitute the entire agreement between us in relation to the services, and supersede any prior discussions or representations.
- Severability: If any part of these Terms is found to be unenforceable, the remaining parts continue in full force.
- Waiver: A failure to exercise any right under these Terms does not constitute a waiver of that right.
- Assignment: You may not transfer your rights or obligations under these Terms without our prior written consent. We may engage other registered practitioners to assist in the delivery of services, subject to confidentiality obligations.
14. Changes to These Terms
We may update these Terms from time to time. Updated terms will be published on this page with a revised effective date. Continued use of our website after a change constitutes acceptance of the updated Terms. Your rights under any ongoing engagement are not affected by changes made after that engagement commenced.
